1. Acceptance of These Terms

These Terms of Service (the "Terms") form a binding agreement between you and the operator of PikpikGo ("we", "us") and govern your access to and use of PikpikGo (the "Service"), an online platform for generating images, video and audio with artificial intelligence.

By creating an account, clicking to accept, or otherwise using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. If you use the Service on behalf of a company or other organisation, you represent that you are authorised to bind that entity to these Terms.

2. Definitions

  • "Account" — the account you register in order to access the Service.
  • "Credits" — the virtual units used to meter and settle consumption of the AI generation features.
  • "Input" — the prompts, text, images, audio, video and other materials you submit to the Service.
  • "Output" — the text, images, audio, video and other results the Service generates from your Input.

3. The Service

The Service provides AI-assisted tools covering the production workflow from concept to finished video. The features available, the Credits each operation consumes, and the price of each plan are those displayed in the Service at the time you use or purchase them.

Parts of the Service depend on artificial intelligence models operated by third parties. Their availability, latency and output quality are outside our control. We may add, modify, suspend or withdraw features, and will give reasonable notice of material changes where practicable.

4. Your Account

  • Register with accurate information and keep it up to date.
  • Your Account is personal to you. Do not lend, share, transfer or sell it.
  • You are responsible for keeping your credentials confidential and for all activity, Credit consumption and charges under your Account.
  • Tell us promptly if you believe your Account has been compromised. We will act within a reasonable time, but we are not liable for losses arising before you notify us.

5. Plans, Credits and Payment

Paid features are sold as membership plans and Credit packs. The benefits, Credit amount, validity period and price applicable to your purchase are those shown at checkout.

Prices are displayed and accounted for in US dollars (USD). Payments are processed by Stripe. Because our payment account is established in Hong Kong, the amount actually charged by your card issuer or wallet provider may be presented in Hong Kong dollars (HKD), converted at the rate applied at the time of the transaction. Your bank or payment provider may apply its own currency conversion or foreign transaction fees, which we do not control.

From 31 August 2026, every newly purchased plan and Credit pack is a one-off purchase. New orders do not renew automatically or retain a recurring charge, and you will not be billed again unless you place another order. When a plan ends, your Account returns to the free tier. Any automatic-renewal subscription created before that date continues under its original terms until it is ended; you can cancel it through Subscription Management in Account Management and must wait for its current period to end before buying a new plan.

Credits on an annual plan are delivered in 12 monthly grants: the first arrives at purchase, and each following grant arrives on the corresponding calendar date until the full annual amount shown on the pricing page has been delivered. Each grant is valid for one calendar month; any unused amount expires when the next grant is issued and does not roll over.

Credits have no cash value outside the Service and cannot be transferred between accounts. Credits included in a membership plan are valid for that plan period and expire when the plan expires; Credits bought as a Credit pack do not expire. Where taxes apply, they are your responsibility unless stated otherwise at checkout.

6. Refunds

You may request a refund within three (3) days of purchase for Credits you have not yet consumed. Credits already consumed by a generation task are not refundable, because the underlying computing resources have been used and cannot be recovered.

To request a refund, contact us through the channels published on the Service and quote your order number. Refund requests are reviewed manually, and approved refunds are returned to the original payment method; how long the money takes to appear on your statement depends on your payment provider.

The full rules — what is refundable, the time limit, how payment fees are handled, and what to do before opening a dispute with your bank — are set out in the Refund Policy, which forms part of these Terms.

Nothing in this section limits any non-waivable statutory right you may have as a consumer under the law that applies to you.

7. Acceptable Use

You are responsible for your Input and for how you use the Output. The detailed rules, including what we treat as a zero-tolerance breach, are set out in the Content Policy, which forms part of these Terms. In summary, you must not use the Service to create, upload, generate, store or distribute material that:

  • is unlawful, or infringes the intellectual property, privacy, publicity or other rights of any person;
  • sexualises minors in any way, or is otherwise harmful to children;
  • depicts a real, identifiable person — including their face or voice — synthetically without that person's consent, or that impersonates any person or organisation;
  • is sexually explicit, gratuitously violent, or promotes hatred, harassment, self-harm or terrorism;
  • is deceptive, including disinformation, fraudulent schemes and manipulated depictions of real events;
  • contains malware, or is used to attack, overload, scrape, reverse-engineer or circumvent any technical limit of the Service; or
  • resells, sublicenses or otherwise makes the Service's generation capacity available to third parties, except as expressly permitted by section 8 (Open Platform API).

8. Open Platform API

We also sell programmatic access to the generation capacity through an open platform endpoint, authenticated with an API key. Calls made through the API consume Credits from the same balance, at the rates published for the API.

An API key authenticates as your Account. Keep it secret, do not embed it in client-side code or public repositories, and rotate it if it may have been exposed. Everything done with your key is treated as done by you and is charged to your Account; tell us promptly if you believe a key has been compromised.

  • You may build the generation capacity into your own product or workflow. If you do, you remain responsible for what your end users submit and receive, and you must hold them to terms at least as protective as these Terms and the Content Policy.
  • You may not resell raw access to the API as a competing generation API, nor pool one Account across unrelated customers to circumvent per-Account limits.
  • Quotas, rate limits and concurrency caps apply as published. We may throttle, suspend or revoke a key that threatens the stability of the platform, that is used for prohibited content, or whose traffic we cannot attribute to a legitimate application.
  • Credits consumed by successful API calls are not refundable. Where a call fails on our side and produces no usable result, the Credits for that call are returned to your balance automatically.
  • The API is versioned and evolving. We may change or withdraw endpoints, parameters and models, and will give reasonable notice of breaking changes where practicable.

9. Your Input and Output

  • You keep whatever rights you hold in your Input. You confirm that you have the rights and permissions needed for everything you submit, including for any person, brand or work it depicts.
  • You grant us a limited, worldwide, royalty-free licence to host, store, transmit and process your Input and Output only as far as is needed to operate, secure and support the Service — including transmitting them to third-party model providers so that a generation task can run.
  • As between you and us, and provided you have complied with these Terms and paid any amounts due, we do not claim ownership of your Output and you may use it, including commercially. Whether Output is protected by copyright, and who owns it, is determined by the law that applies to you — in many jurisdictions purely machine-generated material has limited or no copyright protection.

10. AI-Generated Output

Output is generated automatically by statistical models. It may be inaccurate, misleading, offensive, or similar to material generated for other users from similar prompts. We do not warrant that Output is accurate, original, fit for any particular purpose, or free from third-party rights.

You must review and verify Output before relying on it, and especially before publishing it or using it commercially. Output is not professional advice of any kind, including legal, medical, financial or safety advice.

Where the law that applies to you requires synthetic media to be disclosed or labelled, complying with that requirement is your responsibility. We may attach visible or embedded provenance markers to Output; you must not remove, alter or obscure them.

11. Our Intellectual Property

The Service — including its software, interfaces, the models we operate, trade marks, logos and documentation — belongs to us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any of our intellectual property to you.

12. Third-Party Services

The Service integrates third parties, including AI model providers, Stripe for payments, and cloud storage and delivery providers. Using the Service therefore involves their processing of your data, as described in our Privacy Policy. We are not responsible for the acts or omissions of third parties, and their own terms may apply to you.

13. Suspension and Termination

You may stop using the Service at any time. To close your Account, submit a request through the contact channels published by the Service; we will process it after verifying your identity. Closure cannot be undone: any Credits left on the Account expire immediately and are not refunded, your works, assets and generation history are deleted, and your personal information is anonymised, except for order and transaction records we are required to keep by law.

We may limit, suspend or terminate your access if you breach these Terms or applicable law, if your use creates a security or legal risk, or if we are required to do so by a provider or an authority. Where a breach is not serious we will normally warn you first. Credits and plan benefits lost as a result of termination for breach are not refunded.

Provisions that by their nature should survive termination — including payment obligations, licences granted in respect of Output already produced, disclaimers, limitation of liability and governing law — continue to apply.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any Output will meet your requirements.

15. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive or consequential loss, or for loss of profit, revenue, goodwill, data or Output, however caused.

Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the fees you actually paid us for the Service in the three (3) months before the event giving rise to the claim, or USD 100.

Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the minimum extent permitted by law.

16. Indemnity

You will indemnify us against claims, damages, penalties and reasonable legal costs arising from your Input, your Output, your use of the Service, or your breach of these Terms or of applicable law.

17. Changes to These Terms

We may update these Terms as the Service and the law develop. We will post the updated version with a new "last updated" date and, for material changes, give notice in the Service. Changes take effect when posted, and continuing to use the Service after that means you accept them. If you do not accept a change, stop using the Service; contact us through the published channels if you need your Account handled.

18. Governing Law and Disputes

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws rules. The parties will first try to resolve any dispute informally; failing that, the courts of Hong Kong have exclusive jurisdiction, except that we may seek injunctive relief in any competent court to protect our intellectual property. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of your country of residence.

19. General

  • If any provision is held unenforceable, the remainder of these Terms stays in force.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our consent; we may assign them to a successor in connection with a merger, acquisition or sale of assets.
  • These Terms, together with the Privacy Policy, the Refund Policy, the Content Policy and any terms shown at checkout, are the entire agreement between us in respect of the Service.
  • These Terms are published in several languages. In the event of any inconsistency, the English version prevails.
